ListenStories Terms of Service
§1. General provisions
- These Terms of Service set out the rules for providing services by electronic means through the ListenStories website available at listenstories.app (the Service).
- The Service is operated by [NAZWA FIRMY], address: [ADRES], Polish tax ID (NIP): [NIP], e-mail: contact@listenstories.app (the Provider).
- You can contact the Provider by e-mail at contact@listenstories.app or through the contact form in the Service.
- These Terms are made available free of charge in the Service in a form that allows them to be obtained, reproduced and stored.
- Using the Service requires acceptance of these Terms.
§2. Definitions
- Service — the ListenStories website operated by the Provider at listenstories.app.
- User — an adult natural person with full legal capacity who has concluded a contract for electronic services with the Provider (created an Account).
- Account — the User's individual account in the Service, identified by an e-mail address and protected by a password.
- Plan — a service tier defining the monthly Story limit: Free Trial, Basic or Premium.
- Story — a text work generated by artificial intelligence based on a description provided by the User, together with its audio narration in MP3 format.
§3. Type and scope of services
- The Provider supplies, by electronic means, a service consisting of generating personalized children's bedtime stories with artificial intelligence (AI) based on a description provided by the User, narrating them with a speech synthesizer (audio narration), and storing and playing Stories in the User's library.
- Available Plans:
- Free Trial — 1 Story, free of charge;
- Basic — PLN 33 per month, up to 10 Stories per month;
- Premium — PLN 99 per month, up to 30 Stories per month.
- Currently only the Free Trial is available. Paid Plans will launch soon; until then the payment provisions (§8) do not apply.
- The Story limit of a Plan renews on a monthly cycle. Generating a Story reduces the limit. Deleting a Story does NOT restore the limit. The limit is not reduced if the Service refuses to generate a Story (§6(4)) or generation fails for technical reasons.
§4. Technical requirements
- To use the Service you need: a device with internet access, an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled, the ability to play audio, and an active e-mail address.
- The Provider is not responsible for disruptions caused by the User's failure to meet these technical requirements.
§5. Account
- Creating an Account requires providing an e-mail address, setting a password and accepting these Terms.
- Using the Service requires confirming the e-mail address (verification via an activation link sent to the provided address).
- An Account may only be created by an adult. The Service is intended for parents and guardians — Stories are created with children in mind, but the contracting party and Account holder is always an adult.
- The User must keep the password confidential and must not use other Users' Accounts.
- The User may delete the Account at any time in the Service settings. Deleting the Account permanently removes all of the User's data, including Stories and audio recordings.
§6. Rules of use
- The User must not supply unlawful content.
- In particular, descriptions (prompts) must not contain content that: violates the law or third-party rights, is vulgar, discriminatory, incites violence, is of a sexual nature or is otherwise inappropriate for children.
- Content provided by the User and generated content are subject to multi-layer, automated moderation for safety and child-appropriateness.
- The Provider may refuse to generate a Story if the description violates these Terms or fails moderation. In that case the Plan limit is not reduced.
- Persistent violation of these Terms may result in blocking or removal of the Account, after a prior request to cease the violations.
§7. AI-generated content
- Stories are generated automatically by artificial-intelligence models. Despite care and multi-layer moderation, they may contain imperfections, simplifications or errors. We recommend listening to a Story before sharing it with a child.
- AI-generated content is clearly labeled in the Service as generated by artificial intelligence (in line with transparency requirements, including Article 50 of the EU Artificial Intelligence Act).
- The User may use generated Stories (text and audio) for personal, non-commercial purposes, including within the family. Commercial distribution of Stories requires the Provider's separate consent.
- The Provider does not guarantee the uniqueness of generated content — similar descriptions may lead to similar Stories.
§8. Payments
- This section applies from the day paid Plans launch; until then the Service is available only under the Free Trial.
- Plan prices are gross prices (including VAT where due) and are expressed in Polish zloty (PLN).
- Payments will be processed by an external payment operator (Stripe). The Provider does not store payment-card data.
- A paid Plan is a subscription that renews automatically every month. The User may cancel the subscription at any time, effective at the end of the current billing period, retaining access to the Plan until then.
- Detailed payment terms (including invoices and refunds) will be specified in these Terms before paid Plans launch.
§9. Withdrawal from the contract
- A consumer has the right to withdraw from a distance contract within 14 days without giving any reason.
- Under Article 38(13) of the Polish Consumer Rights Act of 30 May 2014, the right of withdrawal does not apply to contracts for the supply of digital content not delivered on a tangible medium, where performance began with the consumer's express prior consent, the consumer was informed before performance that they would thereby lose the right of withdrawal and acknowledged this, and the trader provided the consumer with a confirmation.
- A Story is generated and delivered immediately after it is requested. By requesting a Story, the User consents to the immediate supply of the digital content and acknowledges losing the right of withdrawal with respect to that Story.
- The right to withdraw from the Account contract (as regards unperformed services) remains unaffected; a withdrawal statement may be sent by e-mail to contact@listenstories.app.
§10. Complaints
- Complaints about the Service may be submitted by e-mail to contact@listenstories.app or through the contact form in the Service.
- A complaint should include the e-mail address linked to the Account and a description of the problem.
- The Provider handles complaints within 14 days of receipt and replies to the e-mail address from which the complaint was sent.
§11. Out-of-court dispute resolution
- A consumer may use out-of-court complaint and redress procedures, including the assistance of a municipal (district) consumer ombudsman or a provincial Trade Inspection authority in Poland.
- The EU online dispute resolution (ODR) platform for disputes between consumers and traders is available at https://ec.europa.eu/consumers/odr.
§12. Personal data
The rules of personal-data processing and data-subject rights are described in the Privacy Policy. Information about cookies can be found in the Cookie Policy.
§13. Changes to these Terms
- The Provider may amend these Terms for important reasons, in particular: changes in the law, changes in the scope or manner of providing services, or security reasons.
- Users will be notified of amendments by e-mail at least 14 days before they take effect.
- A User who does not accept the amendments may terminate the contract before they take effect by deleting the Account.
§14. Final provisions
- The contract is governed by Polish law; this choice does not deprive a consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
- Disputes with consumers are resolved by the court having jurisdiction under general rules (jurisdiction favourable to the consumer).
- Matters not covered by these Terms are governed by Polish law, including the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means.
- These Terms are effective from 2026-07-28.
